Cain Lamarre is looking for a tax litigation lawyer/associate for its Montreal office to join a rapidly growing team of tax specialists.

PROFILE

The ideal candidate will have 10-15 years or more of experience representing corporatoins, trusts, and individuals before tax authorities.

KEY RESPONSIBILITIES

  • The ideal candidate will have 10-15 years or more of experience representing corporations, trusts, and individuals before tax authorities.
  • The ideal candidate will be familiar with the appeal process before the Quebec Revenue Agency and the Canada Revenue Agency, including collection agreements, requests for relief, access to information, and voluntary disclosure.
  • They represent their clients in the Tax Court of Canada, the Court of Quebec, the Federal Court of Appeal, and the Court of Appeal of Quebec, and regularly plead before these courts.
  • The ideal candidate advises their clients on all tax matters, including income tax, consumption taxes, deductions, and withholding taxes.
  • The successful candidate is familiar with negotiating assessment proposals, representing clients before the Appeals Branch, deductibility of expenses and tax credits, characterization of income, net asset, cash flow or index-based assessments, property taxes, tax shelters, the general anti-avoidance rule, social security contributions, requests for relief, estate settlements, collection measures, voluntary disclosures, disallowed business expenses, unreported business income, shareholder benefits, directors’ liabilities, self-employment status determinations, employee benefits, third-party liabilities, and alternative assessment methods.

SKILLS AND QUALITIES SOUGHT

The successful candidate will have the ability to delegate, supervise, and motivate others, and must be a team player. Depending on their profile, the successful candidate may be called upon to play a leadership role in managing the tax litigation team under the direction of the head of the Tax Practice Group. The candidate will have the ability to develop a client base or have an established client base.
